Further to the discussion that will be held at the MBA Mid-Winter Conference, the rights of surviving spouses should be considered in the context of family law planning or disputes, and in the context of estate and incapacity planning. This session will review numerous pieces of legislation that affect the rights of surviving spouses and common-law partners in the event of death of a current or former spouse or partner.
