Manitoba Bar Association Denounces Premier’s Comments on Bail Decision

Winnipeg, MB: The Manitoba Bar Association denounces Premier Wab Kinew’s comments in Question Period on October 7, 2025, in which he publicly criticized a bail decision rendered by a Manitoba judge. The independence of the judiciary is a cornerstone of a healthy democracy. When elected officials weigh  in on matters that are before the courts, particularly in a critical or adversarial manner, it poses a serious threat to that independence. Premier Kinew’s remarks undermine public confidence in the administration of justice and run counter to the constitutional principles that separate the judicial and legislative branches of government

Stacey Soldier, President of the Manitoba Bar Association, strongly condemns the Premier’s comments, saying: “It is concerning when politicians offer commentary on cases before the courts that have not yet been adjudicated. Such comments undermine the rule of law and ignores the presumption of innocence. Furthermore, it could ultimately affect the fairness of a trial which doesn’t just affect an accused person, it also affects victims and loved ones.”

The Manitoba Bar Association reaffirms its unwavering commitment to the independence of the judiciary and the principle that justice must be free from political interference. It is inappropriate and deeply troubling when public officials, especially those in leadership positions, make public statements that could erode trust in the legal system. Politicizing individual court decisions, particularly in active cases, undermines the safeguards that ensure fair and impartial justice for all Manitobans. The Association calls on all elected officials to respect the role of the courts and refrain from comments that compromise the integrity of the justice system.
